Terms of Service

For accounts created before 5 July 2026, the new warranty in Section 8 (consents for third-party data you upload) and the mediation step in Section 14 take effect 19 July 2026. All other changes are clarifications of existing practice, or new commitments from us to you, and apply immediately.

1. Agreement to Terms

By accessing or using AML Mate (“the Service”), operated by Mark Chen trading as AML Mate (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AML Mate is a software-as-a-service platform that assists Australian businesses with AML/CTF compliance management. The Service provides tools for generating compliance plans, managing client KYC records, screening against sanctions lists, AUSTRAC reporting, and employee training.

3. Important Disclaimer

AML Mate is an information and document-preparation tool based on AUSTRAC's publicly available guidance and Starter Kits. It does not constitute legal, financial, or compliance advice, and using it does not make you compliant.

You are solely responsible for your own compliance with the AML/CTF Act and all AUSTRAC obligations. AML Mate does not guarantee any particular outcome, including that any program, report, or assessment generated with the Service will be accepted by AUSTRAC, will satisfy your obligations, or will prevent regulatory action. You are responsible for reviewing, verifying, and (where appropriate) having a qualified professional check everything before you rely on it or submit it to AUSTRAC.

We strongly recommend that you consult a qualified AML/CTF compliance professional, lawyer, or accountant before submitting any compliance program to AUSTRAC. To the extent permitted by law, we are not responsible for any penalties, fines, losses, or regulatory action arising from your use of, or reliance on, the Service.

AML Mate is an independent product. It is not affiliated with, endorsed by, or approved by AUSTRAC or any government agency. References to AUSTRAC and its guidance are for information only.

4. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@amlmate.com.au if you suspect unauthorised access.

All content, features, and functionality of the Service (excluding your data) are owned by Mark Chen trading as AML Mate and protected by Australian and international intellectual property laws. Compliance plans and reports generated for your business are yours to use.

8. Your Data

You retain ownership of all data you submit to the Service. We process your data solely to provide the Service. See our Privacy Policy for details on how we handle your information.

When you enter or upload personal information about your clients or any other third party (including via a KYC link you send to a client), you warrant that you have collected that information lawfully, that you have given any collection notices and obtained any consents required under the Privacy Act 1988 (Cth) — including for its disclosure to us and to the service providers listed in our Privacy Policy — and that you are entitled to provide it to us for processing on your behalf.

9. Confidentiality

We treat everything you store in the Service — your business details, client records, risk assessments, reports, and drafts (including suspicious matter report drafts) — as your confidential information. We do not disclose it except to the service providers listed in our Privacy Policy as needed to operate the Service, at your direction, or where required by law. You must keep confidential any non-public information about the Service that we share with you (such as security details). These obligations survive termination.

10. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

Where the Service is not of a kind ordinarily acquired for personal, domestic, or household use, our liability for failure to comply with an ACL consumer guarantee is limited, to the extent permitted by section 64A of the ACL, at our option to: (a) re-supplying the relevant services; or (b) paying the cost of having the services re-supplied.

Subject to the above, to the maximum extent permitted by law, Mark Chen trading as AML Mate shall not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any AUSTRAC or other regulatory penalty or fine, loss of profits, or loss of data, arising from your use of the Service. Subject to the above, our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Mark Chen trading as AML Mate from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or any third-party claim that personal information you provided to the Service was collected or disclosed without the notices or consents described in Section 8.

12. Termination

We may suspend or terminate your account if you breach these Terms. We will provide reasonable notice unless the breach involves illegal activity or poses a security risk. If we terminate your account other than for illegal activity or a security risk, we will give you a reasonable opportunity to export your data before it is deleted.

Export your data before deleting your account. The dashboard provides CSV and audit-pack exports at any time while your account is active. When the last member of a team deletes their account, all business and client data is deleted immediately and cannot be recovered; the residual account record is removed within 30 days as described in our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Before starting court proceedings, both parties agree to first attempt to resolve any dispute by good-faith negotiation and, if that fails within 30 days, by mediation administered under the Resolution Institute mediation rules (or by a mediator the parties agree on), with the mediator's costs shared equally. Nothing in this section prevents either party from seeking urgent injunctive relief.
